Senior citizen law or elder law issues occur in just about every field of law. Seniors and their families face many questions about the law and how it may apply to them at this stage of their lives. The questions can seem overwhelming at times and can include anything from health and insurance issues to discrimination and civil rights. Aside from being exposed to a whole new set of laws, our seniors face new obstacles every day. Will Medicaid cover my treatment? Am I a target of scams designed to prey on seniors? Will I be able to keep my job? These are all questions that preoccupy and agonize our elders and with good reason for the concerns. The Older Americans Act (OAA) was signed into law by President Johnson in 1965 and is credited with creating the Administration on Aging (AOA), a division within the Department of Health and Human Services. The OAA was amended in 2000 to include the National Family Caregiver Support Program, which was intended to help family members who are struggling to care for their older loved ones. Seniors are especially vulnerable to health issues and insurance scams, but they also have to be aware of unscrupulous predators with illusions of a better life that are just looking to make an easy buck and then just help themselves to the life savings of our precious elders. Seniors fall prey to scams of all types every day that may come from as close to home as a family member.
The major concerns to elders that make up senior citizen law are:
- Estate planning and wills, including tax questions
- Guardianship, conservatorship and powers of attorney
- Disability planning, retirement planning and nursing home issues
- Job and fiduciary matters
- Social Security, Medicaid, Medicare and long-term care issues
- Veterans medical care benefits
- Elder abuse, neglect, and fraud
- Discrimination, ageism and civil rights issues
Life expectancy continues to grow. New data released by the Centers for Disease Control and Prevention's (CDC) and National Center for Health Statistics (NCHS) finds that life expectancy in the United States was the highest ever and continuing the trend shown in recent years. More Americans are living longer and working to older ages every day, according to a recent study by the AARP.
