Uncontested Divorce In DC

Once you and your spouse agree to be divorced you must state there is no hope of reconciliation and you wish to end the marriage. A separation agreement must be in writing describing provisions for:

  • Child Custody
  • Child Visitation
  • Child Support
  • Property Division

Separation Agreement:

Promote the reasonable settlement of disputes between the parties to a marriage attendant upon their separation or the dissolution of their marriage.

In a proceeding for dissolution of marriage or for legal separation, the terms of the separation agreement, except terms providing for the custody, support, and visitation of children, are binding upon the court unless it finds, after considering the economic circumstances of the parties and any other relevant evidence produced by the parties, on their own motion or on request of the court, that the separation agreement is unconscionable.

If the court finds the separation agreement unconscionable, the court may request the parties to submit a revised separation agreement or the court may make orders for the disposition of property, support, and maintenance in accordance with the provisions of sections.

No-Fault Based Grounds:

District of Columbia Code - Title 16 - Chapter 9 - Sections: 904, 905, 906
Mutual separation for at least 6 months with no cohabitation. You may live under the same roof, and you and your spouse can share food, but not the same bed.

A court must approve your reasonable agreement between both of you. Also, if you and your spouse cannot agree or prove grounds for a divorce then you cannot get divorced.

Contested Divorce - Requires adversarial proof.

Beginning 7/29/70, the appeal period is 30 days with provision for an additional 30 days upon a showing of excusable neglect. However, if no appeal is noted during the 60-day period, the divorce is effective after the 30-day period. Since the marriage relationship continues until the decree becomes effective, a remarriage entered into prior to that time is void in all jurisdictions, whether entered into in or out of the District of Columbia.
